WenTianAI Terms of Service Special Notice: Welcome to the WenTianAI platform (hereinafter referred to as "WenTianAI" or "this Platform"), which is operated by SUIKEINC (hereinafter referred to as "SUIKEINC" or "we"). Before using the various services provided by the WenTianAI platform (including its website, iOS application, and other forms), you must carefully read and fully understand the contents of the provisions of this agreement. If you do not agree to this Terms of Service and/or any modifications to it at any time, you may actively stop using the services provided by WenTianAI. Once you use the services provided by WenTianAI (including downloading, installing, launching, browsing, registering, logging in, purchasing, etc.), you shall be deemed to have understood and fully agreed to all provisions of this Terms of Service, including any modifications to this Terms of Service made by WenTianAI at any time, and have become our user. I. General Provisions 1. This agreement is an agreement entered into regarding your registration, login, and use of WenTianAI services. 2. Users may use individual services of various channels and products of WenTianAI, which may be provided to you by SUIKEINC, affiliated companies, or controlled companies. When users use individual services of WenTianAI, the user's behavior of using such services shall be deemed as consent to the terms of service of such individual service and all announcements issued by WenTianAI in such service. 3. WenTianAI's user agreement and the individual service terms and announcements (if any) of various channels and products may be updated by WenTianAI at any time without further notice. When using related services, you should pay attention to and comply with the relevant terms applicable to you. II. Account Registration and Use When you register and use a WenTianAI account, you must comply with the following requirements when using certain WenTianAI products or services requiring registration: 1. After successful registration, WenTianAI will provide each user with a user account, and users may set the account password autonomously. The user account and password are the responsibility of the user to keep; users should bear legal responsibility for all activities and events conducted with their user account. 2. The ownership of WenTianAI accounts belongs to SUIKEINC. After filling in information according to the registration page guidance, reading and agreeing to this agreement, and completing the full registration process, you will be able to obtain a WenTianAI account and become a user, and can use the WenTianAI account and products. Users should provide timely, detailed, and accurate personal information, and continuously update registration information in accordance with timely, detailed, and accurate requirements. All originally input information will be cited as registration information. If any problems arise from false registration information or untimely updates, SUIKEINC shall not be held responsible. You can query and correct your information through the WenTianAI account settings page. Users should register their accounts through real identity information authentication, and the account name, avatar, and introduction information submitted by users should not contain illegal or bad information. After review by SUIKEINC, if any of the above exists, SUIKEINC will not approve it. Meanwhile, after registration, if it is discovered that users fraudulently registered using false information or their account avatar, introduction, and other information contain illegal or bad information, SUIKEINC has the right to take measures unilaterally without notice, including but not limited to requiring correction within a time limit, deleting/resetting avatar information, suspending use, deregistration, and recovery. 3. Based on the requirements of national laws and regulations or WenTianAI service policies, when using certain WenTianAI services, you need to fill in true names, contact information, ID numbers, and other information. You should guarantee the authenticity of the identity information you fill in, and use real, accurate, legal, and valid relevant identity proof materials and necessary information. Please complete the above according to relevant regulations and pay attention to timely updates of the above information. If the materials you submit or the information you provide are inaccurate, untrue, non-standard, illegal, or if SUIKEINC has reason to suspect them to be erroneous, false, or illegal materials, the company has the right to refuse to provide you with relevant services, and you may be unable to use WenTianAI-related services or have some functions restricted during use. 4. To meet the mandatory requirements of laws and regulations, to be necessary for providing products or services, or based on the needs for identifying risks in your account and enhancing verification, when you use face login or verification functions, we will collect and store your facial photos and information. You should complete the corresponding actions according to page prompts, and after the WenTianAI system determines that your actions meet the requirements, facial capture can be completed. You agree that face login and verification services can only be used by you for your own WenTianAI account. To improve verification accuracy, you agree that WenTianAI may, when necessary, compare and verify your facial photos and facial features provided to WenTianAI with facial features stored by institutions permitted by laws and regulations or institutions authorized by government authorities. 5. A WenTianAI account includes account name and password. You may log in using your set account name (including username, mobile phone number, email) and password. During account use, in order to protect account security based on different terminals and your usage habits, we may adopt different verification measures to identify your identity. For example, when your account logs in for the first time on a new device, we may identify your identity through password plus verification code, and verification methods include but are not limited to SMS verification code and service usage information verification. 6. Users should not transfer, sell, or lend their account or password to others. Account usage rights only belong to the person who initially applied for registration, and users should independently bear full responsibility for all activities in their account. If WenTianAI can reasonably determine that the relevant account involves account trading or account theft risks, WenTianAI has the right to independently take measures to freeze or ban the account. If account transfer, buying, or lending causes account disputes, or if WenTianAI cannot determine account ownership, WenTianAI has the right to refuse to provide account recovery. Once such reports or complaints occur, WenTianAI has the right to immediately freeze or ban the account. 7. You should properly safeguard your account and password. You should not believe online information requesting loans, asking for passwords, or involving property. You should not disclose your WenTianAI account, password, verification codes sent to you by WenTianAI to others, nor should you input your WenTianAI account, password, or verification codes on non-WenTianAI websites, or log in through QR code scanning on non-WenTianAI websites. Otherwise, your account may be leaked and your property may be damaged. Losses caused by improper account management by you will be borne by you. At the same time, when such circumstances occur and WenTianAI cannot reasonably determine account ownership, we will be unable to help you recover your account. 8. If your account cannot be used due to personal reasons, please provide relevant information according to WenTianAI account recovery requirements to recover your account, and ensure that the information provided is legal, true, and valid. If any of the following conditions exist: (1) the information provided does not meet requirements; (2) the unique credential of the account is no longer valid; (3) cannot pass SUIKEINC security verification; (4) there is account theft or other security risks, or other situations causing inability to determine account ownership, SUIKEINC has the right to refuse to provide account recovery service and may take measures to freeze or ban the account. If the mobile phone number bound under your WenTianAI account stops being used due to personal reasons, please quickly change the bound mobile phone of your WenTianAI account. Otherwise, if the telecom operator performs a secondary release, subsequent users of that mobile phone number may log in through your original mobile phone number and can view all your account information and product usage information. Your WenTianAI account will not be able to continue being used, and personal information in your account also has the risk of being leaked. Please be sure to timely change your bound mobile phone. If account loss or information leakage results from failure to timely change the bound mobile phone number, you bear the responsibility. SUIKEINC has the right to refuse to provide account recovery service and may take measures to freeze or ban the account. 9. When needing to terminate the use of WenTianAI account services, if the following conditions are met, you may apply to deactivate your WenTianAI account. Account deactivation is irreversible and cannot be reversed, so please operate carefully, and please be aware and confirm: (1) You may only apply to deactivate your own account and proceed with deactivation according to WenTianAI's process. (2) You should still bear corresponding responsibility for your behavior before account deactivation and during the period of using WenTianAI services. (3) Please backup relevant information and data before deactivation. After successful deactivation, unless otherwise provided by law or otherwise agreed between the parties, account information, personal ID information, transaction records, membership benefits, stored information and other information bound to or related to the account will not be recoverable, restorable, or provided. You will also not be able to log in through your original account (even if you re-register through the same mobile phone number or can prove you are the original account owner) or perform any operations, and your newly registered account will not be able to set the original account username. 10. To prevent resource occupation, if you have not used your WenTianAI account for six consecutive months or have not logged in to your WenTianAI account through other methods approved by SUIKEINC, SUIKEINC has the right to recover that account, and you will no longer be able to log into this website or use related services through that account username. If the account has associated pending transactions or balance, SUIKEINC will assist you in handling them to a reasonable extent. Please proceed according to SUIKEINC's instructions. 11. We will use your information according to SUIKEINC's Privacy Protection Statement (https://wentian.dev/privacyPolicy) that you submitted and retained when registering your WenTianAI account and using WenTianAI services. You guarantee that before using all products and services of SUIKEINC, you have fully understood and agreed that SUIKEINC may process user information accordingly. 12. To satisfy the requirements of relevant laws and regulations and protect your account security, especially when you perform sensitive operations such as account unbinding and deactivation, we may send your submitted personal identity information to banks, telecom operators, and other institutions for verification inquiry to verify the authenticity of your identity. Under the premise of complying with legal and regulatory provisions or upon the request of national authorities, we have the right to restrict or freeze your account. In such cases, you may not be able to continue logging into or using your account. If relevant regulations simultaneously require or suggest us to conduct further account authentication, please cooperate. To cooperate with regulatory agencies, law enforcement institutions, and judicial departments, or as necessary to handle litigation disputes related to you (if any), we may provide information related to your account to regulatory agencies, law enforcement institutions, or judicial departments, including but not limited to your registration information, login information, real-name authentication information, binding information, and other relevant information that can reflect your account ownership and usage. 13. You should reasonably register and use your WenTianAI account and should not maliciously register or improperly use it (common improper uses include but are not limited to frequent registration, batch registration, and other behaviors that can reasonably be considered as account operations conducted through machines; malicious abuse of multiple accounts; malicious assistance in verification/account recovery; using WenTianAI accounts for illegal activities, violating this agreement or other product agreements/rules of SUIKEINC (and affiliated companies); or using WenTianAI accounts for other improper purposes). 14. You need to register your WenTianAI account through official WenTianAI channels and should not register or obtain WenTianAI accounts or their login credentials through other unofficial channels. You should not implement behaviors violating laws and regulations, this agreement, and other product agreements of WenTianAI (and affiliated companies) by actually controlling multiple accounts. You should not use any means to circumvent, counter, or destroy platform registration, login, and usage rules. We have the right to make independent judgments about the above malicious registration and improper use behaviors, and when reasonably determining that such behaviors exist, unilaterally decide to take disposal measures. Disposal measures include but are not limited to deleting user-published information, suspending usage rights, terminating services, restricting use, prohibiting login, prohibiting account exchange, prohibiting appeals, recovering WenTianAI accounts, freezing/banning WenTianAI accounts, and pursuing legal responsibility—all of which WenTianAI deems can reasonably be used to dispose of cheating behaviors and protect the platform and user account security. If users have evidence proving they did not engage in the above cheating behaviors, they can make appeals through the contact channels publicized in this agreement. 15. You understand that we have the right to make independent judgments about account behaviors determined by the platform to involve fraud, abnormal operations, cheating, or security risks, and unilaterally take disposal measures, including but not limited to restricting login, requiring improvement of real-name information, freezing accounts, banning accounts, and reporting or transferring to relevant regulatory departments for disposal. 16. We have the right to make independent judgments about any malicious registration, abnormal risks, illegal or improper conduct, violation of agreement terms, or violation of social morality and propriety, and when reasonably determining that such behaviors exist, unilaterally decide to take disposal measures. Disposal measures include but are not limited to deleting user-published information, requiring corrections, suspending usage rights, terminating services, restricting use, prohibiting login, prohibiting account exchange, prohibiting appeals, recovering WenTianAI accounts, freezing/banning WenTianAI accounts, and pursuing legal responsibility—all of which WenTianAI deems appropriate to reasonably dispose of cheating behaviors and protect platform and user account security. For those who repeatedly violate relevant rules and still do not correct their behavior, we have the right to directly ban your account and publicize the relevant results. If users have evidence proving they did not engage in the above cheating behaviors, they can make appeals through the contact channels publicized in this agreement. III. Usage Rules 1. When using SUIKEINC's services, users must comply with the Network Security Law, Anti-Telecom Network Fraud Law, Measures for Security Protection and Management of International Networking of Computer Information Networks, Measures for Administration of Internet Information Services, Provisions on Administration of Internet User Account Information, Provisions on Governance of Internet Information Content Ecology, Decision on Maintenance of Internet Security, Provisions on Administration of Internet News Information Services, and other laws and regulations of the People's Republic of China or relevant countries/regions involved. Users agree that they will not use this service for any illegal or improper activities, including but not limited to the following behaviors: (1) Uploading, displaying, posting, distributing, or in any other way transmitting information containing any of the following content: 1) Opposing basic principles determined by the Constitution; 2) Endangering national security, leaking state secrets, overthrowing national political power, or destroying national unity; 3) Damaging national honor and interests; 4) Distorting, defacing, blaspheming, or denying the deeds and spirit of revolutionary martyrs, or in any way infringing upon the names, images, reputation, or honor of revolutionary martyrs through insult or slander; 5) Advocating terrorism, extremism, or inciting terrorist activities or extremist activities; 6) Instigating ethnic hatred, ethnic discrimination, or destroying ethnic unity; 7) Undermining national religious policy through religious teaching, conducting religious education and training, publishing sermons or turning to relevant content, organizing religious activities, conducting religious ceremonies through live streaming or recording, establishing religious organizations, setting up religious schools and places of worship, developing believers, conducting fundraising under the name of religion, or advocating cults and feudal superstitions; 8) Spreading rumors, disrupting social order, or destroying social stability; 9) Spreading obscene, pornographic, gambling, violent, murderous, or terrorist content, or instigating crime; 10) Insulting or defaming others, or infringing upon others' reputation, privacy, and other lawful interests; 11) Containing false, fraudulent, harmful, threatening content, infringing upon others' personal information, harassment, harm, slander, vulgarity, obscenity, or other morally offensive content; 12) Related to illegal or improper content associated with destructive fishing methods such as electric fishing, poison fishing, or blast fishing that damage fishery resources and ecological environment (including but not limited to text, images, dynamics, videos); 13) Possibly involving content that infringes upon national sovereignty and territorial integrity or violates state regulations regarding map drawing and publication; 14) Containing other content restricted or prohibited by relevant laws, regulations, rules, decrees, and any binding legal norms; (2) Users should not use the network service system for any illegal purpose; (3) Users should not use SUIKEINC's services to engage in the following activities: 2. Without permission, entering a computer information network or using computer information network resources; 3. Without permission, deleting, modifying, or adding to computer information network functions; 4. Without permission, deleting, modifying, or adding to data and application programs stored, processed, or transmitted in computer information networks; 5. Intentionally creating or distributing computer viruses and other destructive programs; 6. Other behaviors harmful to computer information network security. 2. When producing or publishing internet information content through your account, you should comply with requirements and should not create, publish, copy, or forward bad information containing the following content: (1) Using exaggerated titles with content seriously inconsistent with titles; (2) Hyping up scandals, ugly deeds, or other negative stories; (3) Inappropriately commenting on natural disasters, major accidents, or other calamities; (4) Containing sexual innuendo or sexual temptation that tends to cause sexual associations; (5) Displaying bloody, thrilling, or cruel content causing physical and mental discomfort; (6) Instigating discrimination among groups or discrimination based on region; (7) Advocating vulgar, commonplace, or pleasing content; (8) Possibly inducing minors to imitate unsafe behaviors and violating social conduct, or inducing minors' bad habits; (9) Other content negatively affecting internet ecology. 3. If users violate this agreement or relevant service terms provisions, causing or resulting in any third-party claims for compensation, demands, or losses, including reasonable attorney fees, you agree to compensate SUIKEINC and partner companies and affiliated companies, and hold them harmless. Accordingly, SUIKEINC has the right to, depending on the nature of the user's behavior, take measures including but not limited to deleting user-published information, suspending usage rights, terminating services, restricting use, recovering WenTianAI accounts, and pursuing legal responsibility. Users should not engage in copying, pirating, selling, reselling, or using any part of this service or its use or acquisition for any other commercial purpose. Users should bear legal responsibility for their behavior in using SUIKEINC's services. Forms of legal responsibility borne by users include but are not limited to: compensating those who have been harmed, and if SUIKEINC first bears administrative penalties or compensation for damages resulting from user behavior, users should provide SUIKEINC equal compensation. 4. You acknowledge and agree that the services, question and answer information, and other information WenTianAI provides to you are derived based on your location, celestial movements, time, and other information through specific computer algorithms and computational tools. Due to the limitations of relevant theories and computer algorithms, the above information and data are for reference only. You should carefully treat relevant information in WenTianAI and reasoning and analysis based on such information. When you make judgments, make choices, or take any action based on the above information, you should independently bear the resulting consequences. WenTianAI bears no responsibility for your actions based on providing such information. 5. You acknowledge and agree that to improve your experience, WenTianAI may improve the algorithms and procedures of related platform functions based on innovation and development in theories and technology of relevant fields. This may cause changes in all or part of the data and information displayed on the platform related to you. WenTianAI bears no responsibility for your actions resulting from such data or information changes. IV. Service Content 1. WenTianAI is a network product, and the specific content of services is provided by SUIKEINC based on actual circumstances. 2. Unless otherwise explicitly provided in this Terms of Service, all new products, new features, and new services released by SUIKEINC are governed by this Terms of Service. 3. To use this service, you must be able to independently enter the international internet through a third party with legal qualifications to provide internet access services to you, and you should independently pay the relevant service fees. In addition, you must independently provide and be responsible for all necessary equipment needed for international internet connection, including computers, modems, and other access devices. 4. Given the special nature of network services, users agree that SUIKEINC has the right to change, interrupt, or terminate part or all network services (including paid network services) at any time without prior notice. SUIKEINC does not guarantee that network services will not be interrupted and makes no guarantees regarding the timeliness, security, or accuracy of network services. 5. Disclaimer: SUIKEINC is not responsible for network service interruptions within a reasonable time resulting from the following circumstances: (1) SUIKEINC needs to regularly or irregularly maintain or service the platform providing network services or related equipment. SUIKEINC reserves the right to suspend any part of this service for maintenance, repairs, upgrades, or other purposes without prior notice. (2) Due to force majeure reasons such as typhoons, earthquakes, floods, lightning, or terrorist attacks; (3) Due to user computer hardware and software and communication line or power line failures; (4) Due to viruses, Trojan horses, malicious program attacks, network congestion, system instability, system or equipment failures, communication failures, power failures, bank reasons, third-party service defects, or government actions. Notwithstanding the above, SUIKEINC will take reasonable action to actively promote the restoration of normal service. 6. This service or third parties may provide links to other websites or resources on the international internet. Since SUIKEINC cannot control these websites and resources, you understand and agree that SUIKEINC is not responsible for whether such websites or resources are available. SUIKEINC makes no guarantee or assumes no responsibility for any content, advertisements, products, or other information existing in or originating from such websites or resources. SUIKEINC bears no responsibility for any damages or losses resulting from use of or reliance on any content, goods, or services published on or obtained through such websites or resources. 7. Users clearly agree that all risks existing in their use of SUIKEINC's network services will be borne completely by themselves. Users understand and accept that downloading or obtaining any information materials through SUIKEINC's services depends on the users themselves, and users bear the risks of system damage, data loss, and any other risks. 8. SUIKEINC has the right at any time to temporarily or permanently modify or terminate this service (or any part of it), regardless of whether notice is given, and bears no responsibility to users or any third parties. 9. Service Termination You agree that SUIKEINC may, based on its own considerations, for any reason, including but not limited to long-term non-use (exceeding one year) or if SUIKEINC believes you have violated the letter and spirit of this Terms of Service, terminate your password, account, or use of this service (or any part of it), and remove and delete any of your content in this service. You agree that the service provided under any provision of this Terms of Service may be interrupted or terminated without prior notice. You acknowledge and agree that SUIKEINC may immediately close or delete your account and all related information and files in your account, and/or prohibit continued use of such files or this service. Additionally, you agree that if the use of this service is interrupted or terminated or your account and related information and files are closed or deleted, SUIKEINC bears no responsibility to you or any third parties. V. Paid Services and Payment 1. Service Types WenTianAI provides paid value-added services to you, including: (1) Subscription services: For example, "VIP Membership". After you pay the corresponding fees, you will enjoy specific membership benefits (such as unlimited use of specific AI characters, etc.) within a fixed subscription period (such as monthly, seasonal, or yearly subscriptions). (2) Per-use payment services: For example, purchasing single calculation services or specific virtual items. After you pay a one-time fee, you obtain usage rights to that service or item. The specific service content, benefits, and prices are subject to the service pages announced on the platform. 2. Payment Channels and Methods You understand and agree that when purchasing paid services on this platform, you should complete payment through methods specified by us. (1) For iOS In-App Purchases: If you make purchases through WenTianAI's iOS application (including subscriptions and per-use payments), you will pay through Apple's App Store In-App Purchase system. The processing, billing, and management of related payments will follow Apple's terms and conditions. (2) For web or other platform purchases: If you purchase through WenTianAI's website or other channels, you will pay through third-party payment services (such as Alipay, WeChat Pay, Stripe, etc.) designated by us. 3. Subscription Services and Automatic Renewal (1) If you purchase a subscription service, some services may use "continuous subscription" (i.e., automatic renewal) method. When you purchase VIP membership services through continuous subscription, unless you cancel the automatic renewal subscription or WenTianAI suspends or terminates the automatic renewal service in accordance with laws and regulations or this agreement, WenTianAI will charge you service fees at the time of subscription and will automatically charge you for the next subscription period through your payment account at a certain time before the end of the current and subsequent subscription periods. (2) You authorize WenTianAI to automatically deduct the fee for the next subscription period from your payment account (such as the payment method bound to your Apple ID or the payment channel you selected on the web end) when your current subscription period is about to expire. When you purchase VIP membership services through continuous subscription, you acknowledge and agree that you authorize WenTianAI to automatically charge you for the next subscription period from your payment account selected before the current subscription period expires, within the deadline of the current and subsequent subscription periods. You should ensure that WenTianAI can successfully deduct from your payment account. If renewal fails due to insufficient balance or other reasons caused by you, you will bear the responsibility yourself. (3) Canceling automatic renewal: You may autonomously choose to cancel continuous subscription. * iOS users: You need to operate through the "Subscriptions" management section in your Apple ID account settings, closing the automatic renewal function at least 24 hours before the end of the subscription period. * Web users: You need to operate through this platform's website account settings or contact customer service before the end of your subscription period to cancel. You may autonomously choose to cancel continuous subscription. If you need to cancel continuous subscription, you should operate to close the automatic renewal function a certain time before the subscription period expires, and no further fees will be charged after closing. 4. Fees and Refund Policy (1) WenTianAI has the right to independently and periodically adjust service fees and promotional policies. Any price adjustments will be announced or notified through the platform before the adjustment becomes effective. For subscription services, price adjustments will take effect after your current subscription period ends. (2) You acknowledge and agree that since paid services (whether subscription or per-use payment) are all virtual digital goods and online services, after your payment is successful, the service is deemed to have been delivered or performance has begun. Therefore, all payments are final and non-refundable. You have no right to request a refund of paid fees for any reason (unless otherwise required by law). (3) You should ensure that you are the owner of the payment account mentioned above and that your payment behavior does not violate any laws and regulations and does not infringe upon the lawful interests of others. You acknowledge and agree that WenTianAI provides no guarantees for your payment account and payment behavior. Losses and risks of the payment account resulting from non-WenTianAI reasons will be borne by you individually. (4) When you purchase VIP membership services through single-time subscription, you should pay the full service fee one time through the method stipulated in this agreement. 5. Other benefits developed and periodically released by WenTianAI that VIP members enjoy You acknowledge and agree that the names and descriptions of the above service content may be inconsistent with the names or descriptions displayed on the actual page, but this does not affect your normal use of VIP services. The content of VIP membership services is subject to what is ultimately displayed on the VIP membership page. Please carefully review the relevant content before purchasing. When requirements in laws and regulations or from competent authorities change, WenTianAI may modify the content of this service. Meanwhile, to enhance and improve your service experience, WenTianAI may periodically make improvements and adjustments to VIP membership service content. VIP membership services cannot be gifted, transferred, or used for other account-to-account transactions between different accounts. VI. Intellectual Property and Other Lawful Interests (including but not limited to reputation rights and goodwill rights) 1. User Rights Protection If you believe that the use of another person's WenTianAI account (including the avatar, username, nickname, and introduction of a WenTianAI account) infringes upon your lawful interests, please provide information to SUIKEINC according to the following instructions: Please note that if the statement in the rights notice is false, the submitter of the rights notice will bear all legal responsibility for the resulting damages (including but not limited to compensation for various fees and attorney fees). If the above individual or organization is uncertain whether the information obtainable online infringes upon their intellectual property and other lawful interests, SUIKEINC suggests that such individual or organization first consult with professionals. To enable SUIKEINC to effectively process the above individual or organization's rights notice, please use the following format (including the serial numbers of each provision): 1) Proof of ownership of lawful interests in the alleged infringing content by the rights holder; 2) Please fully and clearly describe the situation of infringement of lawful interests and provide information about the alleged infringing third-party account (including username, nickname, avatar, introduction) and website address (if any). 3) Please specify which content of the alleged infringing account infringes upon the rights listed in item 2 above. 4) Please provide specific contact information of the rights holder, including name, copies of ID or passport (for individuals), copies of business registration certificate (for organizations), mailing address, phone number, and email. 5) Please include the following statement in the rights notice regarding the truthfulness of the notice content: "I guarantee that the information described in this notice is sufficient, true, and accurate.
